From last few weeks Banks in India has been pushing customers to link their Aadhar card with the bank account. The bank officials are urging the account holders saying that their account will be put on-hold if they fail to connect their Aadhaar details within a stipulated amount of time.

Striking of all those news about the termination of the bank account the Reserve Bank of India (RBI) has reportedly said that it “has not issued any instruction so far regarding mandatory liking of Aadhaar number with bank accounts.”

Going into the details, the RBI has responded to an RTI petition seeking about the Aadhaar Bank Linkage. According to the Reserve Bank Of India’s response, RBI has not given any official order to the banks about the Aadhar card tie-up, and it is the decision of Central Government alone.

In the response made by the RBI, it stated that “The Government has issued a Gazette Notification GSR 538(E) dated 1 June 2023 regarding Prevention of Money laundering (Maintenance of Records) Second Amendment Rules, 2017, inter-alia, making furnishing of Aadhaar (for those individuals who are eligible to be enrolled for Aadhaar) and permanent number (PAN) mandatory for opening a bank account. It may be noted that Reserve Bank has not yet issued an instruction in this regard”.

Thus by the response of Reserve Bank of India, it is now entirely clear that Aadhaar linking with bank accounts is not mandatory as of now. Even though the Supreme court of India has decided that Aadhaar card is compulsory only for six major Government Schemes, the Central Govt is imposing its mandate for 50 Schemes. Earlier Govt has also made Aadhar Linkage with Driving Licence Compulsory

After the demonization move by our Prime Minister Narendra Modi to curb black money, the government made it mandatory for all the citizens in India to link Aadhaar card number and Permanent Account Number (PAN). The linking is made compulsory to provide Aadhaar and PAN details while filing tax returns by August 31st.

The government has already extended the deadline twice, from July 31 to August 5, and then later to August 31.Now it seems that no further extension of the deadline will be possible. The Aadhaar-PAN linking is aimed at tax evaders who hold multiple PAN cards to escape tax paying. By linking, you no longer need to submit Income Tax acknowledgment to I-T department.

The Supreme Court verdict on privacy as a fundamental right has triggered talk that it may have an implication on Aadhaar, and any adverse impact could affect the move to link PAN and Aadhaar. UIDAI CEO Ajay Bhushan, “taxpayers will have to link their PAN with Aadhaar by the stipulated deadline, which is 31st August, as the Supreme Court verdict on privacy has no bearing on the requirement.”

Recently, government deactivates 11.44 lakh PAN cards after identifying a huge number of fake PAN cards. As per government rules, a person should not have more than one PAN number. The government believes that the linking of Aadhaar and PAN is an effective anti-evasion measure to fight black money, corruption and will further help in streamlining the entire tax filing process.
