Supreme Court Issues Notices to Google Facebook on Sexual Offence Videos

SC issues notice to Google, Facebook, and Microsoft for curbs on sharing of videos related to sexual offences and cybercrime.

Justice Madan B. Lokur and Uday Umesh Lalit wanted explanation from Google India, Yahoo India, Microsoft Corporation India and Facebook about blocking sexual offense videos by January 9

This case is filed by Hyderabad nongovernment organization prajwala. They have sent two rape videos to Supreme Court which are trending in internet sites and many people are sharing this video.

NGO’s lawyer Aparna Bhat said “Sexual offense videos are posting on online, by this type of videos many people will get influenced and takes participation in cyber crime.”

Prajwala foundation submitted the copy of video to the Supreme Court which is trending on the internet, in this video one person is committing rape and another person is filming it.

The government said in the response by the top court, ordering information and technology of ministry act for the way of blocking and reporting videos of rape under the protection of child sexual offenses 2012.

ASG Maninder Singh said that debate is on in the country and abroad on making public of the identity of the sexual offender. Supreme Court said the identity of an alleged rape offender should not be released hardly on the registering the offense but only after conviction.

The bench said if a person gets acquitted even then person would suffer damage to his image because of prior disclosure of his identity. It will defame the image of a person, if he is acquitted in the sexual offense case,” the bench said.

The court also said if any person acquitted of a sexual offense, CBI will not investigate him for cybercrime aspect of the offense

According to National Crime Record Bureau statistics increase in the cases of sexual violence against children, the apex court questioned the Centre to include in the list of measures for curbing crimes against women and the steps to protect children from sexual violence.

Cyber Crime Rises by 350 Percent over Three Years in India: Study

Cyber crimes in India unfolded three times in the time span of 3 years. According to a study by PwC and Assocham, the number of cyber crime cases registered under the IT Act has observed a gain of 350 per cent in a period of 2011 to 2014. The study also cautioned about the rise in cyber attacks around the world with greater frequency and intensity.

Attacks have been mostly begun from the countries such as Turkey, U.S, China, Pakistan, Brazil, Algeria, Europe, Turkey, and UAE. Titled ‘Protecting Interconnected Systems in the Cyber Era,’ the study states that India has evolved as one of the most favorite countries listed among cyber criminals. And this is due to the rapid growth in adoption of Internet and smartphones in the country.

Attackers acquired control over the vital system such as nuclear plants, railways, transportation or hospitals that can subsequently lead to direct consequences such as water pollution or floods, power failures, disruption of transportation systems and loss of life. An increase of nearly 50 percent is observed in the occurrence of cyber crime incidents in the period of 2012 to 2015.

“The profile and motivation of cyber attackers are fast changing. A new breed of cyber criminals has now emerged, whose main aim is not just financial gains but also causing disruption and chaos to businesses in particular and the nation at large,” the study pointed out.

DDOS Attack On State’s Internet Service Providers: Cops Filed FIR

Cyber-attack on small and medium Internet service providers (ISPs) was identified in the state of Maharashtra, India. The cyber-crime branch police on Sunday registered a FIR in relation with the Distributed Denial of Service (DDOS) attack. The state police claimed that this is the first FIR to be filed regarding suck attack in the nation, and the effects of the attack are still continuing.

“Some unknown people are involved in crashing the ports of Internet Service Providers by making lakhs of requests at a particular terminal at a particular time, which we call Distributed Denial Of Service,” said Brijesh Singh, Inspector General of Cyber-crime Police. “We have registered a FIR and started tracking down the operators who are trying to crash the servers or ports of ISPs,” added Brijesh Singh.

According to the investigators, the attack which brought down the speed of the internet services infected millions of IP addresses with a virus known as Trojan. According to the officers, the attack is unprecedented as it is being carried out at a speed of 200 gigabytes per second.

A senior police officer in a statement said that the regular DDOS attacks last for hours and have a specific number of targets but this attack, in particular, has continued for three to four days and focused many ISPs who do not have the infrastructure to defend such attacks. “We have been mitigating the attack, blocking all the Internet Protocol (IP) addresses involved as soon as we identify them. The attack, however, still continues. The resources behind the attack have to be considerable. We are trying to trace the location from which the attack is being orchestrated,” said officer.

The Cybercrime police said many IP addresses around the world are infected with virus Trojans via spam emails or advertisements on web pages, which are not recognised by users. In this case, a Cyber-crime lawyer N S Nappinai said, “Infected IP addresses are routinely sold on the dark net by entities that infect them in the first place. All a hacker has to do is buy enough infected IP addresses and use them for a DDOS attack.”

Very strangely, this DDOS attack of the state was happened after a similar attack took place in the USA, in which the servers were attacked between 17th to 20th July in the Library of Congress

Government Is Taking Strict Action Against Cyber Crimes: Rajnath Singh

Central Government is planning to put an end to cyber crimes, Says Rajnath Singh (Union Home Minister). However, it is observed that the rate of conviction towards cyber crime is a bit low but to tighten more, the centre is taking steps to fight to the total eradication of Cybercrime by the help of some expert group.

During LokSabha question hour time, Rajnath Singh told that the Central is also working on this direction (Cyber Crime).

Kiren Rijiju, Union Minister of State Home Affairs said that threat from cyber-crime is a “reality” that needs to be tackled by sensitising the police and taking other steps. He also stated the government is also taking necessary massive steps and actions against cybercrime.
